License To Carry Eligibility

A person is eligible for a license to carry a handgun if the person meets the following criteria: (Most states have adopted this criteria in one form or another)

  1. is a legal resident of a state within the the United States of America 

  2. is at least 18 years of age

  3. has not been convicted of a felony,

  4. is not charged with the commission of a felony, Class A or Class B misdemeanor, or Disorderly Conduct,

  5. is not a fugitive from justice for a felony, Class A or Class B misdemeanor,

  6. is not a chemically dependent person,

  7. is not incapable of exercising sound judgment with respect to the proper use and storage of a handgun,

  8. has not, in the five years preceding the date of application, been convicted of a Class A or Class B misdemeanor or an offense under Disorderly Conduct, Section 42.01, Penal Code,

  9. is fully qualified under applicable federal and state law to purchase a handgun,

      a. has not been convicted in any court of, a crime punishable by imprisonment for a term      exceeding 1 year;

      b. who is not a fugitive from justice

      c. who is not an unlawful user of or addicted to any controlled substance

      d. who has not been adjudicated as a mental defective or who has been committed to a mental institution

      e. who, being an alien – (A) is neither illegally nor unlawfully in the United States

      f. who has not been discharged from the Armed Forces under dishonorable conditions

      g. who, having been a United States Citizen, has not renounced his citizenship

      h. is not subject to a court order (review for more information)

      i. who has not been convicted in any court of a misdemeanor crime of domestic violence, or transporting/shipping firearms illegally

10. has not been finally determined to be delinquent in the payment of a tax or other money collected by the comptroller,

11. has not been finally determined to be delinquent in payment of taxes collected by the comptroller, state treasurer, tax collector of a political subdivision...

12. is not currently restricted under a court protective order subject to a restraining order affecting a spousal relationship,

13. has not, in the 10 years preceding the date of application, been adjudicated as having engaged in delinquent conduct violating a penal law in the grade of felony

14. has not made any material misrepresentation, or failed to disclose any material fact, in an application summitted
